Event Attendee Terms & Conditions
These Terms & Conditions are applicable to each person who registers for, attends, or is otherwise participating in or present at anyconference or event produced and presented by Diamond Creek Management Group (hereafter “Attendee”), regardless of whether they have received a formal registration.
Registration Fees: All registration fees must be paid in fullprior to the conference/event. Once payment is received an email confirmation will be sent. If payment is not made at the time of registration, registration will be provisional.
Rules, Regulations, & Attendee Conduct. Attendee shallabide by all fire, safety, and health regulations of the local, city, state, and conference/event venues where the conference/event is held. Attendee shall also comply with all applicable federal, state, and local laws and ordinances, as well as all rules, regulations, policies and procedures established by Diamond Creek.
Hotel, Meetings and Hospitality Functions: Attendee shall not, directly or indirectly through employees, associates or others, organize or conduct any type of function in any meeting rooms, restaurants, public areas, hospitality suites, hotel rooms or suites, or other areas of the conference/event venue during the conference/event without prior written consent from Diamond Creek.
Admittance/Removal: In its sole discretion and without refund, Diamond Creek reserves the right to refuse admittance to or expel from the conference/event anyone that it determines is behaving in a manner that could be disruptive to the conference/event or any other attendee or is in violation of these Terms & Conditions.
Speakers: Views expressed by speakers are their own. Diamond Creek accepts no liability for advice given, or views expressed, by any speaker at any conference or event or in any material provided to attendees.
Websites & Links: The conference/event website and associated Diamond Creek websites may link to other third-party websites and networking tools provided for the convenience of users. The contents of these third-party websites are maintained by their owners, for which Diamond Creek and the conference/event organizer(s) assume no responsibility.
Contact Information: By submitting registration details, Attendee authorizes Diamond Creek and other entities(including but not limited to, sponsors, vendors, etc.) associated with the conference or event to contact him/herregarding the conference/event and their respective services. If Attendee wishes to not receive such communications Attendee must notify Diamond Creek at Staff@DiamondCreekMG.com. Attendee’s contact information may also be placed on anattendee list that may be distributed to sponsoring companies and to other attendees to see who is attending the conference/event. If Attendee wishes to not be included on this list, Attendee must notify Diamond Creek at the time of registration.
Event Photography & Recording: Diamond Creek reserves the right, for itself and the conference/event organizer(s), to capture photographs, audio, and video recordings through the entirety of the conference/event. Attendee hereby grantsDiamond Creek, the conference/event organizer(s) and their respective representatives and agents permission to captureAttendee’s image and/or voice in photographs, video and audio recordings for the duration of the conference/event, andto use and distribute (both now and in the future) photographs, videos, electronic reproductions, and audiorecordings of any sessions, events and activities that include Attendee’s image or voice without advance notice or compensation to Attendee.
Photography & Recording by Attendees: Diamond Creekappreciates all coverage of its conferences/events. However, photography, audio, and video recording of the any portion of the conference/event by attendees is strictly prohibitedwithout the prior written consent of Diamond Creek.
Insurance: It is Attendee’s responsibility to arrange appropriate insurance coverage in connection with his/herparticipation or attendance at the conference/event. Diamond Creek will not be held liable for any injury, loss, or liability caused or suffered by Attendee or for any damage to Attendee’s personal property.
Indemnity: To the maximum extent permitted by law, Attendee shall indemnify, defend, and hold harmless Diamond Creek, the conference/event organizer(s), any conference hotel(s), convention center(s) or other venue(s) where the conference/event is being held, and the respective employees, officers, directors, and agents of each of the foregoing, against all claims, losses, and damages to persons or property, governmental charges or fines, and costs, including reasonable attorneys’ fees, arising out of or in connection with the actions or failure to act in accordance with these Terms and Conditions by Attendee, his/her associates, employees, officers, directors, or agents.
Force Majeure: Attendance at the conference/event is subject to acts of God; fire; flood; strike; civil unrest; governmental or military actions; acts of terrorism; acts of war; epidemics, or other disasters or emergencies outside of Diamond Creek’s reasonable control, any of which could make it illegal or impossible for Diamond Creek, and/or the conference/eventhotel(s), convention center(s) or other venue(s) to provide the facilities and/or services for the conference/event, or make it illegal or impossible for Attendee to utilize the hotel(s), convention center(s) or other venue(s) or otherwise participate in the conference/event. Under such circumstances, Diamond Creek may postpone, reschedule or cancel the conference/event entirely without liability on the part of Diamond Creek. If the conference/event cannot be held or is postponed pursuant to this section, Diamond Creek may not be held liable for any damages, costs, or losses incurred by Attendee, including but not limited to transportation costs, accommodations costs or other financial losses suffered. Attendee may request to have his/her registration fee refunded in full.
Survival/Severability: The invalidity or unenforceability of any provision of these Terms & Conditions, whether standing alone or as applied to a particular occurrence or circumstance, will not affect the validity or enforceability of any other provision of the Terms & Conditions or of any other application of such provision, as the case may be.
Dispute Resolution: Attendee and Diamond Creek must firstattempt to resolve any dispute arising between them through friendly negotiations. If the dispute cannot be resolved throughnegotiation, the parties shall participate in mediation in accordance with any applicable statutory rules for mediation. If mediation fails to successfully resolve the dispute, then the parties may seek resolution through the courts in accordance with these Terms & Conditions.
Applicable Law/Jurisdiction/Venue: Attendee acknowledges and agrees that the entire relationship between Attendee and Diamond Creek will be governed by the laws of the State of Utah. Any court action brought by either party pertaining to or arising in any way from these Terms & Conditions or Attendee’s participation or attendance at the conference/eventmust be brought in state or federal courts in or having jurisdiction over Salt Lake County, Utah. Attendee hereby irrevocably consents to the jurisdiction and venue of the aforementioned courts.
